Annual Town Meeting Warrant 2011

TOWN WARRANT

Commonwealth of Massachusetts
FRANKLIN, ss.

To the Constable of the Town of Wendell in the County of Franklin. Greetings:

In the name of the Commonwealth of Massachusetts, you are hereby directed to notify and warn the inhabitants of said Town, qualified to vote in elections and in Town affairs, to meet at the Town Hall in said Town on Monday, June 6, 2011 at 7 pm, then and there to act on the following articles:


ARTICLE 1: To see if the Town will vote to accept the reports of Town Officials as printed in the Town Report, or take any action thereon.

ARTICLE 2: To see if the Town will vote to authorize the Town Treasurer, with the approval of the Selectboard, to borrow money from time to time in anticipation of the revenue of the fiscal year beginning July 1, 2011 in accordance with the provisions of the MGL Chapter 44, Section 4, and to issue a note or notes as may be given for a period of less than one year in accordance with MGL Chapter 44, Section 17, or take any action thereon.

ARTICLE 3: To see if the Town will vote to authorize the Town Treasurer to enter into compensating balance agreements during fiscal year 2012 as permitted by MGL Chapter 44, Section 53F, or take any action thereon.

ARTICLE 4: To see if the Town will vote to fix the salary, compensation, and expenses of all elected and appointed officials of the Town for the fiscal year beginning July 1, 2011, as provided in MGL Chapter 41, as amended, and to see if the Town will vote to raise and appropriate, or to transfer from available funds, or a combination thereof, the sum of $1,954,253 from taxation or such other sum of money as deemed necessary to defray such salaries and expenses for that period, or take any action thereon.

ARTICLE 5: To see if the Town will vote to raise and appropriate or transfer from available funds the sum of $142,012 to pay the fiscal year 2012 debt service on following loans, or take any action thereon.
Fire Truck Note $30,675 ($30,000 principal and $675 interest)
Town Building Projects Construction $65,789 ($15,355.85 principal, $50,453.15 interest)
Fiske Pond Purchase $14,352 (12,000 principal, $2352 interest)
Property at 9 Morse Village Road $17,850 (15,000 principal, $2850 interest)
Mahar Construction $13,346

ARTICLE 6: To see if the Town will vote to raise and appropriate the sum of $12,500 for the Reserve Fund, or take any action thereon.

ARTICLE 7: To see if the Town will vote to raise and appropriate the sum of $20,000 for the Capital Stabilization Fund, or take any action thereon.

ARTICLE 8: To see if the Town will vote to raise and appropriate or transfer from available funds the sum of $ 6,000 for the Insurance Reserve Fund or take any action thereon.

ARTICLE 9: To see if the Town will vote to raise and appropriate or transfer from available funds the sum of $2,500 for the Unemployment Compensation Fund, or take any action thereon.

ARTICLE 10: To see if the Town will vote to raise and appropriate or transfer from available funds the sum of $15,000 for the Pension Reserve Fund, or take any action thereon.

ARTICLE 11: To see if the Town will vote to raise and appropriate or transfer from available funds the sum of $5,000 for the Town Treasurer to utilize for tax title expense, or take any action thereon.

ARTICLE 12: To see if the Town will vote to raise and appropriate or transfer from available funds the sum of $6,000 for the Independent Audit expenses, or take any action thereon.

ARTICLE 13: To see if the Town will vote to raise and appropriate the sum of $500 for the Mediation Account, or take any action thereon.

ARTICLE 14: To see if the Town will vote to raise and appropriate or transfer from available funds the sum of $750 for the Open Space Committee to hire a consultant to create a plan with community input for a permaculture garden on a portion of the Town Office parcel that will provide a stewardship plan for this section of town owned land, serve as an interactive educational demonstration for the community, help to supply food to the Good Neighbors program and other Wendell residents and help to increase local food self reliance, or take any action thereon.

ARTICLE 15: To see if the Town will vote to raise and appropriate the sum of $500 to fund municipal employee website training, or take any action thereon.

ARTICLE 16: To see if the Town will vote to establish the position of Facilities Engineer and to raise and appropriate or transfer from available funds the sum of $1,500 to cover the salary costs for this position, or take any action thereon.

ARTICLE 17: To see if the Town will vote to raise and appropriate or transfer from available funds the sum of $70,000 for a Dump Truck for the Highway Department, or take any action thereon.

ARTICLE 18: To see if the Town will vote to raise and appropriate or transfer from available funds the sum of $15,000 to pay for sitework, equipment, materials, installation, labor, and any other costs related to the remodeling of the playground adjacent to the Library, or take any action thereon.

ARTICLE 19: To see if the Town will accept the recommendations of the Open Space & Recreation Planning Committee as detailed in the Open Space & Recreation Plan dated December 2010.

ARTICLE 20: To see if the Town will vote to apply for, accept and expend any federal, state and private monies, such as Community Development Block Grants, Municipal Incentive Grant, Ready Resource Fund, Public Safety Grant, Massachusetts Public Library Construction Program Funds, etc., or take any action thereon.

ARTICLE 21: To see if the Town will vote to authorize the Selectboard to declare certain items as surplus, and to trade in or sell surplus equipment, or take any thereon.

ARTICLE 22: To see if the Town will vote to authorize the Selectboard to take all necessary and appropriate actions to establish and to maintain, in accordance with the provisions of Chapter 164 of the General Laws and in accordance with the rules, regulations and orders of the Department of Public Utilities and the Department of Telecommunications & Cable, a municipal lighting plant for all purposes allowable under the laws of the Commonwealth, including without limitation the operation of a telecommunications system and any related services, or to take any other action relative thereto.

ARTICLE 23: To see if the Town will vote to eliminate all official posting places for meeting notices except for the bulletin board outside the Town Office Building at 9 Morse Village Road, or take any action thereon.

ARTICLE 24: To see if the Town will vote to reduce the number of members on the Website Committee from 5 to 3, or take any action thereon.

ARTICLE 25: To see if the Town will vote to adopt the following resolution or take any action thereon.

Resolution to Seek Lower Electric Rates in a Competitive Market

Whereas, the Commonwealth of Massachusetts, by enacting Chapter 164 of the Acts of 1997, has established a competitive marketplace through deregulation and restructuring of the electric utility industry; and

Whereas, the citizens of the Town of Wendell in Franklin County have substantial economic, environmental, and social interests at stake; and

Whereas, Wendell's residential and business consumers are interested in reducing their electricity rates;

Be it therefore resolved, that the Town Meeting of Wendell grant the Selectboard authority to develop and participate in a contract, or contracts, for power supply and other related services, independently, or in joint action with other municipalities through the Hampshire Council of Governments. If such contracts are to be approved, individual consumers would retain the option not to participate and to choose any alternative service they desire; and

Be it further resolved, that the Selectboard will appoint a representative for a committee to oversee such joint action.

ARTICLE 26: To see if the town will vote to petition the General Court for special legislation to exempt the town from the provisions of Chapter 111, Section 127A in order to allow the town to develop its own by-laws and regulations to permit alternative energy and sanitation systems for use in owner-occupied residential units, or take any other action in relation thereto.

ARTICLE 27: To see if the town will vote to adopt and amend the following in ARTICLE V Access, Density & Dimensional Regulations, Section B. Other Dimensional Requirements – To be changed to read: “FRONT YARD: The minimum distance between the front lot line and any principal building shall be 35 feet."

ARTICLE 28: To see if the town will vote to adopt and amend the following in ARTICLE V Access, Density & Dimensional Regulations, Section B. Remove: “The minimum distance between the front lot line and any building or structure that contains more than one(1) dwelling unit shall be 100 feet.”

ARTICLE 29: To see if the town will vote to adopt and amend the following. Remove ARTICLE XII Large Development Review. Add the following text in ARTICLE VI Section B, under “Site Plan Review” as the second paragraph: “The construction or renovation of one or more buildings on a single lot or contiguous lots under common ownership that will result in 10,000 square feet or more of enclosed floor area shall be subject to a Site Plan Review, provided the development or activity is not subject to a Special Permit.”

ARTICLE 30: To transact any other legal business that may come before said meeting, or take any action thereon.

And you are directed to serve this Warrant by posting up attested copies thereof at the Wendell Country Store, Wendell Town Hall, Wendell Town Office Building, Wendell Library, and Wendell Depot Store 7 days at least prior to the time of holding said meeting.

Hereof fail not, and make due return of this Warrant with your doings thereon, to the Town Clerk, at the time and place of meeting, as aforesaid
