Zoning Bylaw Hearing

The Planning Board will be holding a hearing on Monday, September 21 at 7:30 to discuss possible zoning bylaw changes.

The following are proposed changes to the Zoning Bylaws:

Article XIII, Section E, 1

Change:

In the Wendell Town Center area, as described by a circle with its center at the Wendell Public Library and having a radius of one mile.

to read:

In the Wendell Town Center area, as described by a circle with its center at 2 Lockes Village Road, the current Wendell Senior and Community Center, and having a radius of one mile.

Article VI, Section F. Use Regulation, 1. Residential Uses

Remove:

Triplex, conversion to a triplex, or conversion to a duplex where a secondary dwelling is on the same lot

Multi-unit dwelling unit structures with more than two (2) dwelling units, provided each unit is no less than 500 square feet.

Article XVI SOLAR OVERLAY DISTRICT

Section A. Statement of Purpose

The purpose of the Solar Overlay District is to provide for Large-Scale-Ground Mounted and Extra-Large-Scale-Ground Mounted solar electric installations by right on lots that are suitable for the development of solar.

Section B. Solar Overlay District boundaries

1. The Solar District is herein established as an overlay district. The Solar District includes Assessor's Map 404, Lot 28 and Map 411, Lot 24.

ARTICLE XVII AGRICULTURAL OVERLAY DISTRICT

Section A. Statement of Purpose

The purpose of the Agricultural Overlay District is to prevent some uses that could be damaging to the limited agricultural soils in Wendell.

Section B. Agricultural Overlay District Boundaries

  1. The Agricultural District is herein established as an overlay district. The Agricultural District includes all Prime Farmland Soils and all Cropland, Pasture as delineated on the Wendell Open Space and Recreation Plan Map titled Prime Farmland and Development Constraints.

Section C. Use Regulations

II. Prohibited Uses

The following uses are prohibited in the Agricultural Overlay District.

    1. Golf course

    2. Automobile service station, repair shop or storage garage

    3. Warehousing

    4. Any industrial use more than 10,000 square feet of building area

    5. Large-Scale ground-mounted solar

    6. Extra-Large-Scale ground-mounted solar

Article III, Definitions:

Dwelling, Multi-family: A structure on a single lot containing more than two (2) dwelling units, each of which is totally separated from the other by an unpierced wall extending from ground to roof or an unpierced ceiling and floor extending from exterior wall to exterior wall, except for a common stairwell exterior to all dwelling units.

 As of January 1, 2010 ZBA does residential special permits such as secondary dwellings and guest cabins.
